'Fair' Trial Will Be a Travesty in Terror Cases
And so, here is how justice is defined: Any accused could be sentenced to death on any charge after a closed proceeding that includes the use of secret evidence he never is allowed to see. There would be no appeal to a civilian court, only to another military review panel appointed by the defense secretary.
"It's the most unfair system that's been contemplated in the United States since we prosecuted Indians during the Indian wars for war crimes," said Don Rehkopf, a former military attorney and now co-chairman of the military law committee of the National Association of Criminal Defense Lawyers.
