This (flamebait) article is worth reading, because it gives you some insight into how the other side thinks. The key false premise in the article is that the DMA's opt-out list is actually respected by email broadcasters. It might be respected by good firms, but it's just way to easy to buy an email list and shoot millions of message out through an open SMTP relay, ignoring whatever industry self-policing has been cooked up.

It must be against the law to intentionally forge return addresses. Spammers must put an opt-out link in their spam that is verified by FTC random checks, and the list that your address was purchased from must be included in the email so you can opt-out from the source as well. That might not solve the whole problem, but it's a good first step.
