Documents in pending challenge to marriage laws in West Virginia
Currently pending before the Court is a petition for a writ of mandamus, seeking to compel the Kanawha County Clerk to issue marriage licenses to same-sex couples. The case is State ex rel. Link, et al. v. King, Clerk, etc.. The petitioner's memorandum in support of the petition was filed today, and the respondent will be filing an initial response by March 30. As is common in such cases, the Court will take up in closed conference whether to hear the case, currently scheduled for April 1. - Initial Papers: including initial petition and related documents; Order of March 5 refusing motion to suspend the rules; Order of March 11 granting petitioner's motion for leave to file a memorandum in support of petition, to be filed within ten days, respondent to file an initial response under RAP 14(b) on or before March 30; Order of March 11 permitting David Shumate and Michael "Andy" Ragland to intervene as party petitioners.
- Order of March 18 permitting J. Wade Davis and Jamie A. Bailey to intervene as party petitioners.
- Petitioner's Brief in Support: filed by Roger Forman, Forman & Huber, and Terri S. Baur, on behalf of the ACLU of West Virginia Foundation.
