Rory Perry's Weblog Law, technology, and the courts Workers' Compensation Opinion Released The Court today released its opinion in Wampler v. Workers' Comp. Commission, et al., etc., a highly-anticipated opinion in three consolidated cases involving the issue of whether it was constitutional for the 2003 legislative changes to workers' compensation laws to be applied retroactively to existing cases. In a 32-page per curiam opinion, the Court agreed with the position taken by the Workers' Compensation Commission with respect to all issues in the cases. The Court stated: "We trust now that the Commission can administer the workers' compensation laws, as modified by the 2003 Legislative changes, in a fiscally responsible and sound manner." Chief Justice Maynard concurred in part and dissented in part and reserved the right to file a separate opinion. Justice Davis concurred and reserved the right to file a separate opinion. Justice McGraw concurred and reserved the right to file a concurring opinion.
