Another CEO turned Criminal Defendant . . .

Fraud Indictments at Adelphia. A grand jury indicted the founder of Adelphia Communications along with two of his sons, charging them with conspiracy, securities fraud, wire fraud and bank fraud. By Geraldine Fabrikant. [New York Times: Technology]

The latest in a growing trend of CEO indictments.  It causes a defense lawyer to wonder what the defendants' counsel will be thinking about during jury selection.  One suggestion might be for the attorneys to recognize the importance of determining which potential jurors' 401(k) funds have been flattened by the recent market downturn.  No easy task to avoid such jurors.

Three cheers for courageous judges  . . .

Judge Rules Federal Death Penalty Unconstitutional. A federal judge in Vermont declared the penalty unconstitutional today, in the second such ruling in less than three months. By The Associated Press. [New York Times: National]

It is always heartening when a judge acts to protect the rights of the acussed without regard to the onslaught of political criticism which is likely to follow.
