Michael Geist's interesting article on extraterritorial jurisdiction. Does the borderless Internet necessitate extension of U.S. (and E.U.) regulations on privacy, copyright, and domain names beyond their national borders? Should a Canadian, operating a website in Canada, in compliance with Canadian regulation be subject to the long arm of U.S. regulation?
If so, how would a U.S. national feel about being regulated by some other foreign country? EU privacy regulation may have this effect on U.S. companies.
International law is supposed to be based on comity and reciprocity. Where one state exercises jurisdiction extraterritorially, other states may exercise the same jurisdiction.
