NY Times article says 43 million Americans used file sharing software.  Super DMCA presumes they are all criminals.

MPAA

Anyone can write a cease and desist letter - but can the MPAA get away with an "ex post facto" claim to the trademark?  Can't the owner of the domain counter that since he had the use of the term almost a year before MPAA registered that it is he who should claim the mark?
