California Supreme Court Revisits Child Custody Move Away Cases. On Monday, February 10, 2004 the California Supreme Court held oral arguments in the LaMusga case. Under current California law -- the so-called Burgess rule -- it is presumed that a custodial parent may relocate with the children unless the non-custodial parent can prove there is bad faith or that the children would be harmed. The Supreme Court's decision is expected within ninety days. Experts hope the LaMusga decision will clarify and elaborate on the Burgess rule.
