A federal court judge refused to grant a stay on the appeal of the University Gardens condo owners, allowing SMU to begin demolition on the property.

President of the Heritage Hills No. 1 Condominum Association Heather Thompson owns Unit No. 1 at 18230 West Third Avenue.  Although she rents out her unit, she said, "I lived there from March 2001 to March 2004. There has always been a problem smelling the smoke

Sauve said the judge ruled Nov. 7 and sided with the HOA. "The judge didn't cite the issue as one of second-hand smoke. She ruled it as an issue of the migration of smoke that constitutes a nuisance, like extremely loud noise." The ruling means if Sauve and Rodger light up, they are breaking the law.
