CO: Smokers appeal ruling Sauve said the judge ruled Nov. 7 and sided with the HOA. "The judge didn't cite the issue as one of second-hand smoke. She ruled it as an issue of the migration of smoke that constitutes a nuisance, like extremely loud noise." The ruling means if Sauve and Rodger light up, they are breaking the law. 10:03:41 AM
