Mesa is trying to decide whether to allow creation of governmental units within the city that could levy taxes and use eminent domain to obtain property. The issue touches on the complexities of Arizona water law, the powers of homeowners associations and whether Mesa should have to pay taxes to tiny governing bodies with perhaps only a few dozen residents each.

The county's insurer, the S.C. Insurance Reserve Fund, decided last summer it would not pay for the defense because the lawsuit alleges Gilland and Worley acted intentionally, not by accident, according to Weaver.
