In a recent case, the developer of a condominium project contracted with a general contractor to construct retaining walls. The general contractor orally subcontracted out the waterproofing and drainage work on the retaining walls. Problems developed: the condo homeowners began to notice wet soil in their backyards and the retaining walls began to exude a white powdery substance. The condo homeowners association sued the general contractor and the subcontractor.
