The dispute involves a 5.5-acre Paia shoreline parcel that had been used as a lime kiln by Hawaiian Commercial & Sugar Co. Kurt Ulmer purchased the beachfront lot from Alexander & Baldwin and initiated the Montana Beach residential condominium, developing three condo lots – called “apartments” in legalese.
