Rory Perry's Weblog Law, technology, and the courts Argument webcast live at 10 The WV Supreme Court's webcast is live this morning at 10:00 am for oral argument in Findley v. State Farm a case which may be of interest to plaintiff's attorneys and those interested in insurance coverage. The case also profiles the classic tension between courts and legislative bodies. The appeal arises from a class action instituted against an automobile insurer, and involves the retroactivity of certain amendments to West Virginia's Uninsured Motorist Law that followed the Court's 2000 decison in Mitchell v. Broadnax. Nationwide Mutual Insurance Company, an auto insurer who is currently a defendant in a similar class action pending in another county, was previously granted leave to intervene and participate in oral argument. In light of the "extraordinary circumstances" present in this case, also participating in oral argument will be a representative of several business and insurance industry associations who filed a joint brief amici curiae. The American Trial Lawyers Association filed an amicus brief, as did the WV Trial Lawyers Association, but neither will be participating in argument. 9:07:29 AM [Permanent Link]
