First opinions of the term and other news

The first seven opinions of the term were released today, including four per curiam opinions and three signed opinions. The signed opinions cover topics such as review of conditional use permits, accommodation of disabilities in the workplace, and right to discovery before trial:

  • CORLISS, et al. v. ARCADIA DEV. CO., et al., No. 31119 (Albright, J.)(Starcher, C.J., concurring)(McGraw, J., dissenting)(Clarifying the limited power of a circuit court to review a decision of the Board of Zoning Appeals)
  • WILLIAMS v. CAMC, No. 31227 (Davis, J.)(Starcher, C.J., concurring)(Holding that an employer's duty to accommodate an individual with a disability under the WV Human Rights Act does not require the employer to eliminate an essential function of a job)
  • SER PRITT v. VICKERS, et al., No. 31356 (Davis, J.)(Maynard, J., disqualified)(Plaintiff must be permitted to conduct discovery following this Court's reversal of a dispositive pre-answer motion, even though the parties may have previously engaged in pre-answer discovery)

Also today, the Court heard over two hours of oral arguments in three consolidated cases involving the constitutionality of video lottery and the funding stream derived therefrom. Documents filed in the consolidated cases are available here.

Finally, the Court yesterday entered an order reinstating the law license of John Hey, with conditions, by a vote of 3-2 (Justices Davis and McGraw would refuse reinstatement).
