HABEAS CORPUS, PROCEDURE :: FOIA should not be used in habeas proceedings to obtain court recordsSER WYANT v. BROTHERTON, et al., No. 30904 -AND- SER VALENTINE v. FRAZIER, No. 30907 (DAVIS, J.)(Albright, J., concurring in part and dissenting in part)(November 10, 2003). Denying prohibition relief sought by two petitioners with regard to requests for court case records to prepare for filing petitions for writs of habeas corpus. Holding that the Rules Governing Habeas Corpus Proceedings, rather than FOIA, control the process for requesting court case records in connection with the preparation of a habeas corpus petition. 5:15:16 PM [Permanent Link]
