Rambus stuns world+dog with Infineon court victory. More comebacks than Lazarus [The Register]
Who let this happen? The finding of fraud against Rambus has been reserved and sent back to a lower court.
An interesting quote from a former FTC officer:
Having framed the duty of disclosure in the above terms, the court concluded that Rambus did not breach its duty as to the SDRAM standard because none of the claims in its patents and pending patent applications reads on that standard
It seems to me that the case that Rambus brought was all about their patents and pending patent applications reading on the standard.
The claim is that Rambus's duty to disclose it's patented and patentable interests covers only previous and current work, and not future plans. However, any of the relevant patents cover work either a) before or during Rambus's JEDEC participation, when they had a duty to disclose their interests, or b) after Rambus's JEDEC participation, where prior art would have been established through the work of the JEDEC participants.
It's either fraud or an invalid patent, take your pick.
