"Hiding behind the First Amendment"
As keen observers of the language used in political and journalistic parlance, we have been keeping a sharp eye on the use of the phrase "hiding behind the First Amendment".
A quick survey of the uses of this phrase shows it being used to criticize producers of violent movies, pornographers, NAMBLA, Marilyn Manson, people who have invited Al Sharpton to speak at a rally, and "mean-spirited" critics of corporations.
This unfortunate phrase is used to give the impression that there is something nefarious or sinister about reliance on and exercise of the liberties guaranteed by the Bill of Rights. More ominous is the thought that only certain types of people should enjoy the right to free speech in this country. Perhaps worse is the suggestion that "mean-spirited" discourse is somehow not worthy of the law's protection.
We know, though, that it is precisely those who are unpopular and out of the mainstream of society who most need the protection of the First Amendment.
