Am I real?
It appears that I exist, blogiphorically speaking, for this blog has been linked to. The good Mr. Barrus has noted my existence. Incidentally, his blog just turned one. Congrats to chris. I'm also somewhat envious of his new view. Though mines isn't so bad...a snow-covered hillside with some bald trees and a train passing by twice a day.

When's a crime?
Regardless of where one stands in relation to Belgium's decision to allow prosecution of Ariel Sharon for war crimes, it is an interesting issue. I'm not too up on it, but what will the relationship between the Hague and the ICC be?

I fould this quote from Meir Sheetrit, Israel's minister of justice, rather odd:

Legally, this is practically a world precedent, a law which allows for the prosecution of a person for alleged actions in the past. It has a clear retroactive nature to it and is, therefore, unprecedented.
Ok, so ignoring Minority Report for a moment, doesn't most prosecution rely on the presumption that actions occurred already (that is, in the past)? It's awfully hard to prosecute someone for murder or, say, war crimes without them having already committed that crime (or at least allegedly). It would seem that Sheetrit believes pre-emptive prosecution is the norm, or at least for war crimes.

If that's the case the Hague has quite a bit of work to do to prosecute a variety of world leaders for potential future war crimes.
