Here's an editorial about Amendment 38 from today's Rocky Mountain News [December 18, 2005, "How not to fix initiative process"]. They write, "Amendment 38, which was recently cleared to become the first initiative on the 2006 ballot, would make several positive changes to the petition process.
But it also includes enough bad ones to justify voting against it. Meanwhile, it would do nothing to rectify the biggest single weakness of the present system: the fact that it's just as easy for citizens to change the Colorado constitution as it is for them to pass a law by statewide vote. As we've argued for several years, it ought to be harder to pass a constitutional amendment because it's much, much harder to change one after it has been approved...There are certain proposals we do like. Extending the circulation period for signatures to 12 months from six is reasonable. So is allowing petition organizers who don't make the August deadline for that year's election to keep circulating through 12 months and qualify for the following year's ballot. A related provision prevents protests to the court from cheating petition sponsors from what little time they now have to get their measure on a ballot."
