Rory Perry's Weblog Law, technology, and the courts Visitors from Brazil for today's docket As part of West Virginia State Bar's ongoing work with Partners of the Americas, several Brazilian judges, law professors, and criminal justice professionals from the state of Espirito Santo will be attending court proceedings today. We have both a Motion Docket and Argument Docket today. The Court's Motion Docket is an opportunity for counsel to make an oral presentation to the Court as to why the petition for appeal should be granted. Only the petitioning side appears. At the close of the day, the Court will vote on the petitions for appeal presented. Cases on the Argument Docket, in contrast, have been previously granted, fully briefed, and are argued by both sides. The visiting Brazilians are interested in criminal cases, particularly sentencing issues. The proceedings will be webcast. Incidentally, the first case on the Motion Docket today involves a constitutional challenge to the state's sexual offender registration laws. 9:44:30 AM [Permanent Link]
