I've seen companies' patent portfolios with holding that are sometimes retarded (Amazon), or sometimes fraudulent (Rambus). However, sometimes a patent is awarded for someoen being smart.
At first blush, I don't see anything negative about the patentability of bi-phase modulation. More importantly, I don't see anything restrictive about its necessity for UWB. A standards body could very well pick some other modulation, or they could decide that this particular patent encumberance it worth it. That is why we form standards bodies, and why we leave such decisions to them.
