Patent

XtremeSpectrum's patent portfolio on UWB (Ultra Wide Band) is reason enough to oppose the adoption of the nascent standard.  Let's hope the FCC waits until the 802.11 standard evolves to the same point rather than jump to a proprietary solution. [John Robb's Radio Weblog]

I've seen companies' patent portfolios with holding that are sometimes retarded (Amazon), or sometimes fraudulent (Rambus). However, sometimes a patent is awarded for someoen being smart.

At first blush, I don't see anything negative about the patentability of bi-phase modulation. More importantly, I don't see anything restrictive about its necessity for UWB. A standards body could very well pick some other modulation, or they could decide that this particular patent encumberance it worth it. That is why we form standards bodies, and why we leave such decisions to them.
