Lawyers Don't Know Third-Party Composition Denise Howell: A Lawyer Licenses Her Weblog. [Scripting News]
Great discussion by lawyers about the new Creative Commons licenses. It was intuitively obvious to me the first time I saw the XML representation of the CC licenses that there was a huge open question regarding scope. Of course, when I began to read more about the law and licensing, and studied a hand-full of licenses, I realized that lawyers don't know a damned thing about third-party composition. They cut-n-paste, like first year CS students.
There's already plenty of best practice in the software development community regarding third-party composition. The lawyers interested in the Creative Commons will discover this best practice, and the problems will largely go away. The day untrained individuals can craft legal documents using XML-based tools will be a wonderful day, indeed. 4:22:32 PM
