No federal pre-emption for products liability lawsuits against boat manufacturers for failing to install propeller guards. The ABA Journal reported that the United States Supreme Court ruled in Sprietsma v. Mercury Marine that neither the Federal Boat Safety Act nor a Coast Guard decision pre-empts State products liability lawsuits against boat manufacturers for failing to install propeller guards. The Court made a subtle distinction between federal regulators affirmatively making a decision and deciding not to make a decision.
