ERISA Trumps Fairness and Reason Again
Supreme Court rules that ERISA preempts state patients' rights laws. The US Supreme Court has ruled that the Employment Retirement Income Security Act preempts state laws that allow health plan participants to sue their health plans for denying coverage.
