The Court's ruling depended on a detailed question about how to construe certain language in the DMCA. The DMCA created a special protocol whereby copyright owners could compel ISPs, via special subpoenas, to reveal the identity of ISP customers. The question was whether that special protocol applied to the facts of this case; the parties agreed that if it did apply then Verizon had to turn over the customer's identity.The ruling (PDF format) [via Freedom to Tinker]
The Court ruled that the DMCA language did apply to these facts, so Verizon had to comply with the RIAA's subpoena. The Court noted that Verizon had not raised any Constitutional issues, so the only issue before the Court was how to interpret the DMCA. The Court did say in passing, quoting the Supreme Court's Eldred opinion, that it would be skeptical of any Constitutional challenges to the special subpoena protocol.

The first day of my little poll in the aggregator experiment appears to have gone very well. There were 6 votes registered when I first posted it (those were the original votes sent to Loyd by email), and there's now 32 votes (and growing) 15 hours later. I only get so much traffic, but spreading the poll by other bloggers is giving it more exposure - that's the idea behind it.
As of this morning, I know the poll has also appeared at Loyd's site plus The Shifted Librarian (thanks Jenny) and Generic|Synthetic (thanks Rob). I have my fingers crossed that more bloggers will post it on their blogs (or mention it) in the days to come. Otherwise, it will quickly die as it disappears from each participating blogger's main page. So, if you see the poll and want to help keep it alive, post it on your blog (or just link to one of its current locations) a few days from now, or next week... please help spread the poll so the size of sampling grows and the results really mean something...
