Is E-Bay's Alleged Effort to Protect Customers from Fraud a Basis For Its Police Friendly Information Policy?
In this post, LawMeme (Defending eBay? [LawMeme: Legal Bricolage for a Technological Age]) takes on recent commentary which appeared on the Volokh Conspiracy which protested that E-Bay policy is the result of its efforts to protect its customers from fraud. In a recent post, I contended that the policy relates more to a pro-law enforcement mindset in the company's legal department. Wherher I am correct or not, it is clear that position taken by the Volokh Conspiracy is inconsistent with the policy itself. If E-Bay were only concerned with fraud it would not be difficult to have a policy of disclosure sans subpoena in cases involving allegations of fraud. Instead, E-Bay will honor all law enforcement requests equally regardless of their purpose and will turn over the information.
E-Bay is clearly willing to "auction" away its customers privacy, in this case to government -- who after all can only be here to help us.
