Another Legislative Attempt to Emasculate the Judicial Branch!

Bill to Limit Downward Departures in Sentencing Passes the House. This just in from Kyle O'Dowd, Legislative Director for the National Association of Criminal Defense Lawyers ( NACDL): On March... [TalkLeft: The Politics of Crime]

As if the U.S. Setencing Guidelines did not do enough to do away with judicial discretion in sentencing, this new legislative development seeks to take away the small amount of discretion which the Supreme Court's Koon decision established.  Another unfortunate illustration of the inanity of allowing the political branch  - i.e., Congress -- to remain popular by claiming to send "criminals away" to serve increasingly long sentences.  When will these eggheads realize that we cannot afford, either financially or morally, to continue to lock away more Americans each year based on cookie cutter justice?
