The ABA section of litigation has published a paper on-line dealing with some electronic discovery issues.

In R. v. Smith, 2004 SCC 14, the Supreme Court of Canada held that the appeal of a murder conviction should not continue after the appellant had passed away.  The Court acknowledged that courts have the power to continue with an appeal "in the interests of justice", but this case did not fall within that category.
