On September 14, the Town of Bayview board considered the issue of the trees along the south side of Peacy Road for one last time. Despite a report suggesting several alternatives by Randy Lund, of Lund Engineering in Washburn, the board voted to proceed as planned with the cutting of the trees. Cutting will most likely be done next week.

As this issue went forward, it became clear to me that the issue of winter snow removal was more important than that of drainage. Randy's report addressed drainage, but he himself admitted that the trees were likely an impediment to the expeditious removal of snow.

So, Mike and Wayne of the town road crew will get their ditch and their easy snow removal. I just hope they don't mess up the drainage in the process, as the little creek that drains my property and crosses Peacy road flows to the Sioux River, an important trout and salmon spawning stream.

Attached below are the minutes of the board meeting, in case you are interested. The board members said to me that the "improved" road will increase my property value, which is not something I care about, since I have no plans to sell anyway. I just hope it does't raise my taxes!

There is one bright note in all this. Marty Melchior, of InterFluve, will use the trees cut on my property in a trout habitat improvement project on a Bayfield County stream. The trees that sheltered me from snowstorms during deer season for many years will now provide shelter for young trout and salmon. That's a much better fate for them than being cut into lumber.



Monthly Board Meeting

Town of Bayview

September 14, 2004

Call to Order: Chairman Don Jenicek called the meeting to order at 6 p.m.

Roll Call: Present - Chairman Don Jenicek, Supervisor Bob Mick, Supervisor Bob Bodin, Clerk Sue Jenicek and Treasurer Carol DeMars. Absent: None

There were also 9 people in attendance.

Approval of Minutes: Motion to approve minutes as presented was made by Bob Mick, second by Bob Bodin. Motion carried.

Treasurers Report: Treasurer reported $37,310.39 in checking, $280.59 in Equipment Fund Savings, $2261.22 in Room Tax Savings and $33,385.44 in Tax Levy Savings. Treasurer stated that our line of credit interest percentage went up to 3.75% but there are no outstanding loans at this time. Motion to approve the treasurer[base ']s report as presented was made by Bob Bodin, second by Bob Mick. Motion carried.

Payment of Bills: Bills were presented in the amount of $34,427.75. Motion to approve payment of bills, $34,427.75, as presented was made by Bob Bodin, second by Bob Mick. Motion carried.

Citizen Concerns and Comments

Ed Gruhl requests Town Board Recommendation for a Special Use Permit to build a residence in F1. Mr. Gruhl explained that he wants to build a home. His land is on the end of Church Corner Road and that his land is on the town boundary line. Motion to approve Permit request for Mr. Gruhl was made by Bob Mick, second by Bob Bodin. Motion carried.

Peacy Road - Randy Lund from Lund Engineering, did a site evaluation at the request of Dan Small, property owner along Peacy Road. Each Board member did receive a copy of the evaluation. Mr. Lund stated that when he first looked at the road, the best thing for the town was to cut the trees. He stated that he looked at the area in general and obliviously the trees are shading the road, snowplowing is an issue; there is no room to put the snow and not a lot of room for drainage. Mr. Lund gave the board his comments on ditch work. He stated that ditching along just Mr. Small's property, it might not solve the whole problem. There are restrictions in the area and from Mr. Small's property going toward Komborski Road and past it, there is another culvert on Peacy that has end sections but the ditch is really narrow. Minor excavation would turn the water more quickly and help that ditch line drain. Also, to look at ditching on the north side, a ditch on that side would improve drainage. He stated that the trees are dying due to drowning and damage from snow removal and that some have been cut for the power line. He stated that a big issue is snow piles and no melting because of lack of sunlight and if the trees are not cut, the issue will never be solved. Discussion was held. Mr. Lund stated that Mr. Small understands that if the trees must go, he would like to know that it is done right and problems would be solved. Chairman stated that no ditch work could be done until the board hears from the DNR. Supervisor Bodin stated that safety is a big issue and the road needs to be maintained so emergency vehicles can get through at all times.

Supervisor Mick stated that Ed Wroblewski has requested work be done on Peacy Road, that there have been times he has not been able to get to his property. Chairman stated that the trees are scheduled to be cut on Monday, September 20, 2004.

Roth Edwards asked the board to do the things Mr. Lund stated before they cut the trees.

He stated that cross culverts to the north side for drainage would be a better thing. Board stated that there is no ditch on the north side, and it doesn't address the snow issue.

Paul Johnson gave the board a hydrology report for the area. After reading it, Supervisor Mick stated that it is complicated but does it not say that we have to take the trees down because there is not room for a ditch? Mr. Johnson's answer was, "when you look at the way the soils are, when they are saturate rated, you will get a lot of run off and a one to two foot ditch is needed and in order to do that you need to include the bottom flat part of the ditch and the side slopes." Mr. Johnson stated that with any properly made ditch the trees must be removed. He stated that there are time that water has backed up at Felty's culvert because of improper drainage to let the water flow and the water comes up over the road. The board thanked Mr. Johnson for his work on the report. The board decided to proceed with work as planned on Peacy Road.
