Dave Winer's Status

I am a bit confused by this post at Scripting News. Dave Winer claims on one hand:

"To Mr Coates at Plastic Bag, yes, UserLand plays very fair and open." "We invented XML-RPC and SOAP ..." implying that he is speaking for Userland and that he is still involved.

Then later in the same post he states:

"I've never filed for a patent. I can't speak for UserLand, I haven't worked there for almost two years."  implying that he is not part of Userland (and has no current involvement).

So am I to assume that Dave has no current connection with Userland (not an employee, not a shareholder?), has some unstated involvement with Userland, or is still part of Userland or ...? Confused is what this post leaves me.
