Last week, I had lunch with Dave Stutz, Miguel de Icaza, and several members of the Rotor team. Miguel had fun teasing people that his mere presence would infect the entire Microsoft campus with the GPL virus. Dave clearly was battling an infection of an entirely different kind as he was under the weather at the time.
There was much interest in the topic of licenses. Miguel explained how it is the copying and distributing that triggers the GPL, and mentioned something that sounded very much like what Eben later said - "If there is no copying there is no infringement". He also explained how many GPLed code bases are dual licensed to accomodate commercial use.
Within every corporation, different license are employed at different times. Lawers provide input, but so do technical folks and executives. Ultimately, license terms and policies are business decisions.
Yes, there certainly is a lot of fear being spread, as well as uncertainty, and doubt. The best antidote is a skeptical and inquisitive attitude.
