"Apple Computer has obtained the exclusive U.S. rights to distribute the soundtrack to 20th Century Fox's film, 'The League of Extraordinary Gentlemen.' Apple is selling the album for US$9.99 as an online download at the iTunes Music Store. That's not unusual. What is, however, is the fact that no physical CDs are being made for the U.S. market. Two interesting court rulings: "A federal court has ruled that pop-up ads for rivals of U-Haul International, placed atop the moving company's own site by a third-party software application, are legal." [news.com]; "A recent U.S. Supreme Court decision shedding doubt on the legality of reverse engineering could have a significant impact on the way software is commonly developed and improved." Despite the fact that some of what the RIAA's senior vice president of business and legal affairs makes no logical sense, this is still an interesting debate between him and Freenet's inventor, Ian Clarke.

Where the RIAA's man, Matt Oppenheim, totally leaves the real world is in saying Freenet "is not more of a threat than any of the popular p2p services." It is more of a threat because it is unlikely (although, admittedly, not completely inconceivable) that the RIAA will have the practical means to sue individuals who make copyrighted music files available on Freenet.
