Readers have been delighted with the news that the push to enact UCITA in the state is being dropped by its sponsoring organization. While some have over-reacted by assuming this means the total victory now belongs to those of us who oppose UCITA, most understand the war goes on.
"Glad to see you're remaining on guard with this stuff," wrote one reader. "The most bizarre part of this is the use of the term 'Electronic Self-Help.' It sounds like something that any consumer would want. 'Gee, maybe I won't need to call tech support if this product will allow me to help myself.' My guess is that it's designed to bring in votes from people who didn't read the legislation and slept through the hearings."
The fact that UCITA remains the law in Virginia and Maryland was still a major concern for many. "All this suggests that we should be reading all those licensing agreements to check for a Maryland or Virginia choice of law provision," pointed out one reader.
"You are exactly right in declaring a win on the battle but not the war,' wrote another reader. "Congratulations for spearheading the vocal opposition. I encourage you to keep a diligent watch for us software/IT consumers on the ongoing efforts of groups that will try to resurrect UCITA in other forms over the next couple of years.
