Software Patents

Paul Festa: "A federal appeals court partially reversed a lower-court decision that had exposed Microsoft to $565 million in damages. The patent infringement case, brought by the University of California and its Eolas Technologies spinoff, had riled the Web over potential ripple effects that could have forced changes in millions of Web pages that use plug-in applications like Macromedia Flash and Adobe Acrobat that run inside the browser." 2008 Presidential Election

Political Wire: "Sen. Evan Bayh (D-IN) 'is making staff and fund-raising changes that some interpret as laying the groundwork for a potential presidential bid,' the Indianapolis Star reports. 'The most noticeable changes are to his leadership political action committee, a fund-raising tool often used by presidential hopefuls to help fund campaign explorations.'"

Meanwhile, according to the Washington Times, presidential candidate Bill Richardson, is trying to establish a reputation as a tax-cutter. From the article, "New Mexico Gov. Bill Richardson, the only Democratic governor to make business and personal income-tax rate cuts a major part of his agenda in a time of tight budgets, said his party should work to foster a friendlier, pro-tax-cut image that puts more money into the pockets of ordinary taxpayers...Mr. Richardson, who has led a postelection movement to make the Democratic governors a more influential policy-making force in the party, has reduced his state's income tax from 8.2 percent to 4.9 percent and cut the capital gains tax in half." Sounds like a westerner.

2004 Presidential Transition

Tuesday, U.S. Senator from Colorado Ken Salazar, urged President Bush to withdraw some judicial nominees, according to the Denver Post [March 2, 2005, "Salazar urges rescinding controversial nominees"]. The Senate has confirmed over 200 of the president's appointments but Democrats have used filibusters and the threat to stall a handful. From the article, "Sen. Ken Salazar urged President Bush to withdraw his most controversial judicial nominees Tuesday, including that of former Interior Department Solicitor William G. Myers, the highest-profile Western appointee. Salazar, D-Colo., who angered many Democrats when he publicly endorsed Attorney General Alberto Gonzales, said he stepped into the bitter battle over nominations to further his goal of a more bipartisan Senate."

The Denver Post editorial staff weighs in on Senator Salazar's gambit [March 2, 2005, "Salazar asks Bush to withdraw nominees"]. They write, "Myers went before the committee on Tuesday and is likely to win its endorsement, given the 10-8 GOP edge on the panel. But Senate Minority Leader Harry Reid said when the nomination gets to the floor, most Democrats will oppose him. Majority Leader Bill Frist has threatened to advance a rule change that would require only 51 votes to end a filibuster on judicial nominees rather than the current 60.Insiders refer to that as a 'nuclear option' and, for his part, Salazar told The Post: 'I would hope that issue is not one that has to come up. That's the reason I sent my letter to the president.'"

Colorado Water

Here's the latest snowpack news from the Rocky [March 2, 2005, "Some hope seen in snowpack"]. From the article, "March 1 statewide snowpack levels registered 109 percent of average, well ahead of last year but down slightly from last month's 114 percent, according to the Natural Resources Conservation Service...The state's watershed is made up of eight major river basins. Those in the southwest continue to see spectacular snowpacks, with the San Juan basin at 145 percent of average and the Rio Grande at 147 percent of average. But the South Platte, which supplies about half of metro Denver's water, was the driest in the state, registering 80 percent of average. The other major supplier to metro Denver, the Colorado River basin, was 98 percent of average."

"March 1, 2005 Snowpack: Gunnison 133; Upper Colorado 98; South Platte 80; North Platte 88; Yampa/White 84, Arkansas 120; Upper Rio Grande 147; San Juan 145."

Also from the Rocky, "A divided Senate voted 19-15 for Senate Bill 62, which would limit water claims for kayak courses."

Here's an article on rural water problems around Durango from the Durango Herald. They write, "An area-wide potable-water system might better serve residents of rural La Plata County in place of individual wells - which in Southwest Colorado have become a hit-and-miss proposition - according to a report received Monday by county commissioners." Update: MakesMeRalph: "John Salazar (D-Manassas), who knows something about water law, being a potato farmer in a desert, is concerned about Josh Penry's (R-Grand Junction) inter-basin water compact legislation."

Maybe HB 1177 is a 2 billion dollar slush fund to finance water grabs.
