Any Attorneys Out there?

I have a legal question that perhaps someone out there can help me with.  When I sold my house yesterday the buyer's attorney wrote checks to all the involved parties and dated them YESTERDAY (11/25/2002) BUT those checks where NOT given to the involved parties because "there was a problem with the wire transfer and the funds were not in the account".  The checks ended up being held by my attorney "until we have confirmation that the funds are in the account".  To me this is a pretty clear cut case of bank fraud -- knowingly writing checks on an account when the funds aren't there is fraud.  It's also called check kiting.  So here are the questions:

  1. Am I right?  Was fraud committed?  Does it matter if the period of fraud was only for 1 day (and mind you we're talking a house sale so it was a LARGE sum of cash)?
  2. How do I report an attorney for ethical violations?  Specifically does anyone know how to do it in Massachusetts?

Answers muchly appreciated.  (And if you think I was insane to go along with this a) My attorney recommended that I do so and b) You've probably never sold a house -- sucky things happen).

Well I've been offline on IM for like 2 weeks now but some folks have been kind enough to send me stuff anyway so here's one of them.  From The Kalsey Group comes the tip that you should never throw out a hard drive that was built in the last 5 years or so.  "If it's dead then you can usually RMA them and get a new drive.  So that 1.2 gig drive that won't mount might be able to be traded for a new 20 gig".  That's a wicked good idea and I think I need to do this.  Good call.  Thank you !

Well the house sale is complete and title has been transferred.  I'm going to write up a more lengthy commentary about my buyer and why, in my opinion, you shouldn't ever hire him (he's an attorney and if he does business the way he handles his personal life then oh dear god; no words, save those that involve 2^2 letters which I try not to use here, apply).  I would comment this:

If you're selling a house then NEVER, EVER sell it to an attorney. 

The term "evil" comes to mind.  But again this is opinion solely (and I'm being very careful here since when I post his name I could get sued).  Ah well...  The closing was on a Monday and this fits right in with my recent "Life of Mondays".
