Internet Radio's possible solution - Bill Exempts Small Webcasters from Paying Royalty Fees.

6:43:10 PM

The TradeMark Blog asks - Can't you just make up a new name, Mr. Disney?  and then goes on to observe that "if owners of the world's 10 most valuable brands approached trademark lawyers today to clear those marks, doctrinaire lawyers might advise them to avoid over half of them." Analyzing the top 10 brands, Marty concludes that "5 and possibly 6 of the world's most valuable brands would probably receive preliminary refusals to register from the US trademark office. So trademark lawyers are needed, after all."  The Trademark Blog

Marty also uses the top 10 list of well-known brand names to conduct a mini-seminar on trademark law.  Good stuff.

Brian Peterson is a Blawger - and I assume that Denise will process him with the usual dispatch.  I'm adding him to my blogroll.  I note that he is in West Virigina, so I'll tell him that he needs to check out Rory.   Too bad Brian doesn't have Radio 'cause then he could get the West Virginia Supreme Court opinions as an XML feed.

The Internet Radio Fairness Act - according to this story, " the bill would exempt from royalties any business that makes less than $6 million in annual revenue, a group that would include the vast majority of online radio stations unaffiliated with a larger Internet or broadcasting company. "  Thanks Donna.

Ranking State's Tort Systems - The US Chamber of Commerce has released its 2002 ranking of State's liability systems.  The Top Five States were Delaware, Virginia, Washington, Kansas, and Iowa.  The worst five were Mississippi, West Virginia, Alabama, Louisiana, and Texas.  You can access the report here (in PDF form).

The Herd goes where the grass is - "America Online now has only a 4 percent share of the 12 million broadband subscribers in the United States, and now experts are asking if it may be dragged down by the reverse phenomenon: if none of your friends use America Online for broadband, why would you?"  New York Times

Copyright Jitters - A clerk at Kinkos refused to let the author of a newspaper article copy his own article over fear of copyright violations.

Fast Food Lawsuits; what's next? -  apparently lawsuits against those who market milk.  Got money?

Bryan Responds to my post about Sen. Berman of file-sharing bill fame -  "Good luck getting rid of Berman, he's been East Valley's rep for twenty years now. His district is overwhelmingly Latino and Democrat so if you want to chuck him out do it during the primaries with a Latino candidate."  YACCS Comments for Ernie the Attorney

And Dave Winer reports: "I got a great political action plan from an anonymous wage slave in the entertainment industry."

Meanwhile, if you like to know what your representatives' net worth is, John Robb has got a pointer to: "Rollcall.  Wealth ranking of congressmen and senators. "

SeniorMag.com provides new legal resources for seniors -  "SeniorMag.com, a leader in providing resources for seniors and family caregivers announces it's new legal resource center, Legal Corner, a resource of documents and lawyers that specialize in the needs of seniors and their families."  PR Web - Legal

Traffic Law Enforcement: In Whose Best Interests? -  "If you've ever received a ticket for a moving violation, you have probably wondered whether that one ticket improved traffic safety at all. Some tickets certainly increase safety, by removing blatantly irresponsible drivers from the road and punishing unsafe behavior. Many motorists, however, have wondered whether the majority of traffic tickets are in the best interests of society. There seem to be two interests at work here, and they are not on the same team. Are our traffic laws designed to improve safety, or to guarantee a stream of revenue to various groups?"  kuro5hin.org
