CARP: Radio Stations Appeal Internet Royalty Decision

Reuter's is reporting that the Radio stations have asked a federal appeals court to rule that they do not have to pay musicians and recording companies when they play music on the Internet because they do not pay royalties for regular over-the-air broadcasts.

The ball is now officially in play. The appeal was filed by the National Association of Broadcasters (NAB,) and Bonneville International Corp., Clear Channel Communications Inc, Cox Radio Inc, Emmis Communications Corp, Entercom Communications Corp and Susquehanna Radio Corp. None of which has a record label, I believe.

The webcasters have not joined this appeal. Nor have they filed their own court case-- yet. I suspect it's coming very soon. RIAA has made no comment yet.

It is going to be a hot summer in the Court House this summer!

The Kanas City Star News has broke the story that the Roy Rogers Museum located along I-15 in Victorville, California (on your way to Las Vegas,) is moving to Branson, MO. To say the City of Victorville is not thrilled would be an understatement as the town has been the home of Roy and Dale Evans for many years. Both Roy and Dale are buried in Apple Valley.

The museum which features cowboy and Western heritage exhibits, and Trigger will open next spring in the Branson, Missouri city officials announced Monday.

The interesting thing about the situation is that the oldest son Roy "Dusty" Rogers is not the only child of the family. Roy and Dale adopted several children over the years. Rumor has it the adopted kids are all very successful in their own right, but you never hear about them now that Dale as died. Dusty demands all the spotlight and has made more than one enemy in Hollywood. Also rumor has it that times haven't been real good to him so he's reverted to eBay to unload some of the stuff from Roy's collection. As far as anyone can tell, Dusty's never had a real job which wasn't connected to his father's name. His band Dusty Rogers and the High Riders is a knock off of his father's Sons of the Pioneers. The new band will also perform in Branson as well. It should prove interesting.

Another reason Dusty is saying good bye to Victorville is basic economics. The value of the (now) prime property and taxes of the museum has skyrocketed in the past few years. No doubt the Victorville property will be sold at a premium price, leveled to make more obscene track homes or a strip mall. That cash will fund the building of the new museum in Branson. Hopefully Dusty will get business smart and make this a good move for everyone. But time will tell.

However Dusty took one last swipe at Victorville and California with his parting statement:

"We know Mom and Dad have a big fan base in the Midwest because people there still promote love of country, faith in God and true family values. The same virtues characteristic of my parents."

Meow.

The Reason For Radio Silence

A few of you have emailed me asking for the reason for my online silence over the past few days.  Let me give it to you by the numbers:

  1. We had company. To be exact a family member came to visit for several days. I can't write and talk to her at the same time. Now while this was wonderful, we didn't get enough time to go places or do much because...
  2. Doug got nailed by a headhunter for a position with a major company. Normally we would have blown the headhunter off, but this one was not only good, but straight. She interviewed Doug for one lower position and then out of the blue tells Doug there is another major management position available however-- it hasn't been made public yet. After talking to the company the headhunter and the hiring manager with the company decided that Doug's "perfect" for the better management position. (I cringe in horror, as we've been down this road before...so here we go...)
  3. For the next several days, while my cousin sat around waiting for us-- being a real good sport, as we blew her precious vacation time. In order to make this up, we've promised her a ticket back out here on us for the next trip.
  4. The headhunter and the company ran us ragged. Doug because he was the candidate. Me because someone had to get all the information and background crap together and negotiate the finer points of the employment contact. Also I asked them some pointed questions regarding the chain of custody of the material they collect on Doug's background check. (I could write a book on that conversation.) Doug had to work while all this was being done-- just in case the potential position went down the crapper. (See? We've been through this before!)
  5. Now we're in the final stretch. Yesterday we got all the personal references called. Doug had to go take a drug test today and turned in all the paperwork for the background check. So now we're keeping our fingers crossed nothing pops out of the woodwork that is incorrect or untrue which could torpedo the job.  Silly question, but anyone have a clue what you can do if someone obtains an incorrect background check?
  6. And now we're waiting and trying to play catchup on all the stuff we should have done while we had company. What a pile of crap is built up on my desk!

And that answers that.

Jen Checks Out - I Check Back In: It's Vacation Time!

"The Shifted Librarian says: "You're probably on your own for a couple of days while I'm off playing in the city with a friend who's visiting from out of town. I don't think the hotel we're staying at has high-speed internet access (boo, hiss hiss), but it's "girl's 36-hours out" anyway, so expect few to no posts until Wednesday night.  :-)"

It is definately vacation time here in Blogland and the University of Blogaria. People are taking off and getting out of town to visit family and old friends. Or having they are having their families decend/invade for summertime vacation trips.  Either way it's more of a family and friends themed summer vacation season than in years past. My off the cuff guess is-- 9-11 made us take a second look at how we've been spending our time. In my opinion it's a good deal.

In the next few weeks, if things go as planned (insert laughtrack here,) we will be going back to Illinois to attend my 30th Class Reunion, seeing family, friends and classmates. It should prove interesting. I'll  be posting pictures and my comments as I do the trip. We're still not sure we're flying or driving.

Can anyone tell me if United or what airlines are allowing laptops to be used in flight?  When my cousin was here last week, she told me that ATA Airlines is not allowing people to use laptops and a lot of electronic devices in flight. Is this the norm? Or an exception? I haven't flown a mile since 9-11, so I'm clueless.

More in the morning. I've finally gotten free of company and Doug's personal/professional life demands.

Oh yes-- Could someone please tell me why Verizon Wireless gives the lamest customer service in the world?  45 minutes to wait to be told they did not have the phones we needed in stock? We ended up having to drive like a bat out of hell to another store 15 miles away to arrive barely in the nick of time. Picture me not happy.
