Could terrorism result in a constitutional dictator?. I ran into this interesting link on a couple weblogs this week, and thought it would make for an interesting kuro5hin discussion. A columnist for CNN's Findlaw section wrote a piece about the possibility of a constitutional dictatorship in the wake of more terrorism. Could George W. Bush follow in the footsteps of past Presidents like Lincoln and FDR and circumvent the legislature in an attempt to secure order? [kuro5hin.org]

Both the CNN column and the discussion on kuro5hin.org seem to have missed a point which I think should be obvious. No constitutional dictatorship can exist in the US, because the US Constitution has no provisions for a dictator. Of course, that's not to say that an unconstitutional dictatorship couldn't arise, and that's what the article is really talking about. As someone who's actually read the Constitution of the United States, I submit that discussing this possibility as speculation is rather silly.
