Jack Balkin raises an interesting argument about the possibility that the decision in Eldred vs. Ashcroft points out the unconstitutionality of the DMCA.

FCC Chairman Powell
Michael Powell, the son of Colin Powell, is the Chair of the Federal Communications Commision. The Economist is running a short article about the important issues this year in the Telecom Industry and the decisions Powell will help make this year. He's on the record saying that Tivo is God's Machine.

2003 Denver Election for Auditor
Dennis Gallagher has raised $29,000 so far for his run at being the next City Auditor according to the Denver Post. From the article, "'Some people start in a rush, others keep plodding along with patience and perseverance. That's what I intend to do,' he said."

2003 Denver Municipal Election
Candidates are raising lots of money for the election in May, including a non-candidate, Mayor Webb, according to this article in the Denver Post. Penfield Tate loaned his campaign $100,000. That's gotta hurt. Denver election filings are due today. The Rocky also has a list of some early filings.

2003 Denver Mayoral Election
Penfield Tate is also in the news regarding his law firm and a case against a Sheriff's deputy. His firm is representing a woman that alleges that she was thrown from a van by the deputy. Tate says that he'll resign from the firm if elected to avoid the appearance of conflict. Sounds to me like he'll do the right thing. Here's the link to the article in the Denver Post. Tate also, sort of, resigned from the State Senate yesterday to devote his time to his campaign according to the Denver Rocky Mountain News.
Sue Casey pulled a picture of herself with Ted Hackworth from her website. It seems that he felt it implied that he was endorsing her for her Mayoral bid. The article in the Rocky quotes Hackworth as saying, "It's not that we're not friends," he said of the former councilwoman. "It's just that I think she'd be a lousy mayor." Ouch.
