Time To Testify 

 WARNING:Although I will attempt to keep the next few posts as "agreeable" as possible, realize that they may very well contain graphic information not suitable for some audiences! It is my interpretation of the events as I experienced them.

The trial began with the selection of 12 jurors and two alternates. And while that may seem like a very simple thing to do, understand that there were well over 100 people from which to choose. One by one each was called to the jury box, the judge and each of the counsels asked several pointed questions. Questions regarding the basic facts about the potential juror, their background, any hardships this trial may create, their family, occupation and finally whether or not they could be as impartial and fair as the law requires.Police_Department Each responded in his or her own way, many reciting obviously rehersed scenarios of the reasons they would be unable to serve. Some stories were questionable, some sincere. Others were blantant lies, but one by one people were selected or excused. This "simple process" took nearly two FULL days to accomplish and with a case as severe as this, it was quite understandable. Once the selection was completed the testimony began quickly. Witnesses were brought forth and testified to specific occurrences. There was examination and cross-examination. One witness required an interpreter as English was not his main language. A basic timeline was offered by the prosecution and refuted by the defense. Elements of people, places and objects were introduced and likewise, an alternative view was then offered. Evidence was offered to describe these facts:

 1. That the defendant had possession of a firearm.

2. That the defendant met with and was associating with, two alleged "gang members".

 3. That these three conspired to commit a robbery upon an individual seen on the public street, in the light of day.

 4. That another by-stander nearer the three, happened to be in the wrong place at the wrong time, and that the defendant decided to commit robbery upon this individual by use of the firearm.When the victim did not respond, the weapon was pointed directly into his eye, whereby, he then relinquished his money.

5. That the defendant, after committing the robbery, then decided to cross into the street and attempted robbery upon the individual which he and the other two had first conspired.

6. That the second victim did not, or would not allow himself to be the victim of the robbery, and was thus, shot...unfortuantely, in the head. Following this, you can imagine the mayhem that must have ensued. Police, ambulance and finally a medical helicopter arrived. The shooting victim was airlifted to the hospital where, still alive, remained in a coma for four days. Afterwhich, he saddly died. (to be continued)
